Understanding the divorce process

If you are considering divorce, it’s crucial to understand the legal requirements involved and make an informed decision about whether divorce is right for you.

 

No fault divorce

A significant change in the law has aimed to make divorce a less acrimonious process. The Divorce, Dissolution and Separation Act, introduced in April 2022, allows individuals to apply for divorce without apportioning blame to either party. This no fault divorce approach means that either one party or both can initiate proceedings simply by stating that the marriage has broken down irretrievably, without needing to provide a reason or prove it.

Importantly, there is now a “reflection period” of 20 weeks after applying for divorce, before a conditional order can be sought.

 

Key considerations before applying for divorce

With the new law in place, there are several key considerations to take into account before applying for divorce:

1. Type of application: Joint or sole

You will need to decide whether to submit a joint application with your spouse or to apply individually. A joint application can be made if:

  • Both parties agree to the divorce.
  • There is no risk of domestic abuse.

If you opt for a joint application, both parties must use the same method—either online or by post. You will both need to confirm at each stage that you wish to proceed. If your spouse ceases communication, you can continue the application as a sole applicant.

2. Arrangements for children, money, and property

Before applying for divorce, it’s advisable to discuss arrangements regarding:

  • Child arrangements, including maintenance payments
  • Division of finances and property
