What is professional negligence?
Professionals can sometimes get things wrong and negligence arises when a professional either fails to perform their duties to the required standard of skill or breaches a duty of care.
Professionals such as architects, surveyors, engineers, accountants, barristers, and solicitors can make mistakes. Sometimes these mistakes can cause considerable loss, upset and stress to their clients. Professionals invariably do not make deliberate mistakes and have insurance cover for the times that mistakes are made. However, these claims can be both complex and/or may involve dealing with the professional’s insurers.
Our team at Mayo Wynne Baxter can help deal with claims of professional negligence. Our team at Mayo Wynne Baxter can discuss both the merits and risks of any potential claim and the funding options that may be available to you.
If you believe you’ve received poor professional advice, we can assess your case and guide you through the claims process.

Funding your professional negligence claim
Funding your claim is our priority. We offer flexible options including ‘no win, no fee’ and discounted fees. Third-party funding or insurance might also be available. Trust is essential, so we provide clear cost estimates and regular updates. We explore all funding avenues to ensure your case proceeds without financial barriers.
There are different methods of funding your claim and our aim is to be flexible in providing a solution to your funding needs. For instance, we may act on either a ‘no win, no fee’ or ‘discounted fee basis’ dependant on the nature of your claim. Alternatively, we may be able to obtain either ‘after the event insurance’ or 3rd Party Litigation Funding depending on both the value and merits of your claim.

Professional Negligence Solicitors FAQs
The relationship between a client and any professional is based on trust, legal duties and contractual obligations. In any litigation claim, the basis of trust with that professional has already been damaged.
We aim to make sure that the relationship you have with Mayo Wynne Baxter is clear, concise and understood by all parties and so we can work to achieve the desired outcome. As you will understand, any work done for you in a litigation case has to be paid for.
Ultimately, it is the client’s responsibility to meet these costs. However, there are various ways in which the cost of pursuing a claim can be funded. We aim to be as transparent as possible about our charges so funding should not be a bar to you pursuing a claim if your case is sufficiently strong.
Unless you agree with us one of the alternative funding arrangements, we will charge you on the basis of our normal Terms and Conditions of business. These set out the nature of the relationship between us and set out our charges which are calculated on the basis of the time we spend progressing your claim.
We provide an initial estimate of costs which we will only revise if the scope of the case changes. We estimate up to, for example, the lodging of your claim at court, and try to provide you with an estimate of the next stage of your case.
We can also agree at the outset if you wish to place a limit on the costs that will be incurred. We can then seek your permission before further work on the case is done.
Remember, an estimate of costs is a general guide rather than a binding quotation however, we will inform you if and why your costs will exceed any estimate that we give.
There are also a number of other funding options. Please let us know if you want further information on any of the following:
- Funding from third parties; or Risk sharing with insurers;
- or Risk sharing with lawyers;
- or Risk sharing relates to those who may offer to share the risk of your litigation.
Risk sharers include insurance companies, lawyers or combination on these two.
Some cases will simply not be suitable for risk sharing and third parties, who offer to fund you, will expect to share the rewards. However, we can advise you on these specific arrangements.
