Helping you understand your maternity rights
The Employment Team at Mayo Wynne Baxter know that if you’re employed and pregnant, you want to fully understand your maternity leave rights.
Under current maternity law, you are entitled to 12 months leave, irrespective of the hours you work or length of service.
In addition to this, the law on maternity leave means you’re entitled to 26 weeks Ordinary Maternity Leave (OML) which you can start up to 11 weeks before your due date. You are then eligible for Additional Maternity Leave (AML) of 26 weeks, which commences from the end of the OML term.
You may be entitled to Statutory Maternity Pay (SMP), however the level and durations of SMP depends on your individual circumstances.
Don’t let maternity discrimination affect your employee maternity rights
With the assistance of our dedicated team of employment solicitors, we will ensure that the law on maternity leave is enforced to prevent any form of workplace discrimination. Employers who fail to follow maternity leave legislation could face an Employment Tribunal claim. The following instances are examples of employers failing to follow the correct procedures. Our team can help you determine if you are experiencing maternity discrimination:
- Appeals for flexible working are refused without explanation or reason
- Being marginalised as a result of your pregnancy
- Being selected for redundancy on the grounds of your pregnancy
- Failure to carry out health and safety risk assessments
- Certain changes or reshuffling during your maternity leave absence
Contact the Employment Team today to discuss your maternity leave rights or to arrange an appointment with our experts.
