Fixed Fee Debt Recovery Services

Below is a breakdown of the fixed fee work offered by our Debt Recovery Team.  There will be certain occasions when the fixed fee will be governed by the value of the claim. In those circumstances, we will refer you to a Schedule of Recoverable Costs.

Letter Before Action – “LBA” 
The fee is £40 plus VAT. A reduction is available for bulk instructions.

Consideration of your instructions.
Generation of the LBA and sending it to debtor at all relevant addresses.
Email to you with a copy of the LBA confirming that it was sent.
Upon expiry of LBA, we will seek further instructions.

Claim Form
For the fixed fee and corresponding Court fee, please refer to the Schedule of Recoverable Costs

Acceptance and initial consideration of your instructions.
Generation of the Claim Form.
Claim Form sent to Court for issue.
Providing you with confirmation that the Claim Form has been sent to Court.
Providing you with confirmation that the Claim Form has been issued.
Seeking further instructions in the event that the defendant replies.
Seeking further instructions if the defendant does not reply.

Receipt of a defence
Legal advisor's hourly rate applies

Strictly speaking this section should not be incorporated into this document. But for the avoidance of doubt, unless otherwise instructed, upon receipt of a defence, advice will be given on the merits of the defence and how the case should be progressed. This will be charged at the legal advisor's hourly rate.

Judgment
For the fixed fee and corresponding Court fee, please refer to the Schedule of Recoverable Costs

Application to Court for judgment.
Providing you with confirmation that judgment has been obtained.
Letter to Defendant with copy of judgment

Instructing a High Court Enforcement Officer – “HCEO”
£51.75 plus VAT fixed fee. £50 Court fee. Abortive fee of £60 plus VAT if the HCEO is unable to successfully execute the writ.

Application made direct to the HCEO
Forwarding of all updates from the HCEO

Any negotiations or further instructions sought will not be covered by the fixed fee and will be charged at the legal advisor's hourly rate.

Instructing a County Court Bailiff
£2.25 plus VAT fixed fee. £100 disbursement.

Application made direct to the Bailiff
Forwarding of all updates from the Bailiff

Any negotiations or further instructions sought will not be covered by the fixed fee and will be charged at the legal advisor's hourly rate.

Charging order
£250 plus VAT fixed fee. £100 Court fee and £55 Land Registry.

Application to court for a charging order
Service of the charging order on all creditors
Lodging of interim charging order at Land Registry
Preparing for final charging order
Updating you at various stages
Attendance at final hearing

Attachment of Earnings
£150 plus VAT fixed fee. £100 Court fee.

Application to the court for an attachment of earnings order
Updating you at various stages

Third Party Debt Order
£350 plus VAT fixed fee. £100 Court fee.

Application to the court for a third party debt order
Personal service of the third party debt order
Attendance on the third party at the time to serve the order
Updating you at various stages

Any negotiations or further instructions sought will not be covered by the fixed fee and will be charged at the legal advisor's hourly rate.

Order to obtain information from a judgment debtor
£305 plus VAT fixed fee. £50 or £100 Court fee.

Application to the court for a third party debt order
Personal service of the order on the defendant.
Updating you at various stages

Statutory Demands – Company and individual
£250 plus VAT

Preparation of the statutory demand
Personal service of the statutory demand
Reporting to you when the statutory demand has been served

Any negotiations or further instructions sought will not be covered by the fixed fee and will be charged at the legal advisor's hourly rate.

Bankruptcy petition 
£600 plus VAT fixed fee. £790 or £795 Court fee. If the petition is adjourned for an additional hearing, then further fees and disbursements will be incurred.

Preparation of the bankruptcy petition and affidavit in support.
Issue the petition in the local court
Arrange for petition to be personally served
Report back to you at every stage
Arrange attendance at the bankruptcy hearing

Winding up petition 
£700 plus VAT fixed fee. £1,392 Court fee to issue the petition. If the petition is adjourned for an additional hearing, then further fees and disbursements will be incurred.

Preparation of the winding up petition and affidavit in support.
Issue the petition in the local court
Arrange for petition to be personally served
Arrange for the petition to be advertised
File all documents in advance of hearing
Report back to you at every stage
Arrange attendance at the winding up petition hearing
