Over many years we have all become aware, through our daily newspapers and the media, of the continuing problem of the negligent care of the elderly in care homes around the country. Whilst most people are undoubtedly provided with the dedicated care and attention they require, clearly many receive care falling below the reasonable standard to which they are entitled.
With an increasingly ageing population, and increasing numbers of people now residing in care homes, the issue of care home negligence is one that is, unfortunately, likely to become more common and to negatively touch upon many more families.
Negligence in the care home environment can of course take a number of forms. There have been reported cases of extreme physical or sexual abuse but perhaps more prevalent are those that arise from pure lack of care. This could include deprivation of basic needs such as provision of food and drink, failure to provide necessary medication leading to a deterioration in their condition, or even death, and other basic human requirements which we would all expect to be provided for our relatives and friends.
It is clear that many of the care homes are simply not able to provide people with the attention and quality of care that they reasonably require. In these circumstances negligence almost inevitably occurs, much more frequently than if appropriate care was provided.
Obtaining compensation for elderly relatives in these circumstances is fraught with difficulties. Their frailty, whether physical or due to dementia or other age related conditions, make it difficult for the injured person to provide a clear recollection of events.
